ASPECTOS LEGAIS DA POLÍCIA OSTENSIVA DE COMPETÊNCIA DA POLÍCIA MILITAR

Abstract

The present research seeks to understand the competence of the military police in the Brasilian police system. The Federal Constituition of Federal Repulic of Brazil of 1988 presented a significant advance regarding public security and reserved a prominent role for the military police. Aware that this outcome is not a matter of chance, but is the result of a long process of evolution experienced by the policie, from the distant 10th of May 1808, the date of the creation of the General Police and Court Intendency, maturing during the imperial and republican until the promulgation of the1988 Constitution, which reserved the military police with the responsibility of the osntensive police and  preservation of public order. This mission is still poorly understood by society in general and specifically for the military police, who are beginning to glimpse their real task.
